Terms of Use

Please read these Terms of Use ("Terms") carefully as they govern your use of PayCaddy's chatbot service.

  1. Acceptance of Terms

By accessing and using our chatbot, you agree to be bound by these Terms, which establish a contractual relationship between you and PayCaddy. If you do not agree to these Terms, you may not access or use the chatbot service.

  1. Scope of Service

The PayCaddy chatbot offers the following services:

  • Transaction inquiries: You can request information about your recent financial transactions.
  • Card management: You can instruct the chatbot to block or unblock your card and review card details such as PIN and expiration dates.
  • Authentication support: The chatbot facilitates OTP verifications sent to your registered email for secure transactions.
  1. Authentication Process

As part of accessing the card management services via the chatbot, you agree to authenticate your identity through a one-time password (OTP) sent to your registered email address or mobile number. By entering the OTP into the chatbot interface, you confirm your identity as the cardholder and authorize the requested actions. You acknowledge the importance of safeguarding OTPs and agree not to disclose them to unauthorized individuals. Failure to authenticate or misuse of OTPs may result in temporary suspension of access to card management services.

  1. User Responsibilities

You agree to:

  • Provide accurate and current information as required by the chatbot for performing its functions.
  • Use the chatbot solely for lawful purposes and in accordance with applicable laws and regulations.
  • Maintain the confidentiality of any identification or access credentials related to your account.
  • Promptly notify PayCaddy of any unauthorized use of your account or any breach of security.
  1. Prohibited Activities

In using the PayCaddy chatbot, you are prohibited from:

  • Engaging in any activity that would interfere with or disrupt the chatbot services or the servers and networks connected to the chatbot.
  • Using the chatbot to solicit or provide illegal services or activities.
  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  1. Personal Data Actualization

By utilizing the chatbot for card management services, you consent to keeping your personal information accurate and up-to-date. You acknowledge that timely updating of personal data, including contact details and identification information, is essential for effective communication and security measures. You agree to promptly notify PayCaddy of any changes or inaccuracies in your personal information through the chatbot interface or other designated channels. Failure to provide accurate and current information may impede your ability to access or use the card management services. Additionally, you understand that ensuring the accuracy of personal data is a legal obligation under relevant data protection regulations, and you commit to fulfilling this obligation as a condition of using the chatbot.

  1. Conversation Privacy

It is hereby clarified that PayCaddy does not retain any information pertaining to the conversations between the cardholder and the chatbot. All interactions and communications conducted through the chatbot interface are transient and not stored or recorded by PayCaddy. This includes but is not limited to queries, requests, and responses exchanged during the course of utilizing the card management services. The privacy and confidentiality of your interactions with the chatbot are paramount, and PayCaddy is committed to maintaining the security and integrity of your personal information. Any data exchanged during these interactions is solely for the purpose of facilitating card management services and will not be stored or used for any other purposes without your explicit consent, except as required by law.

  1. User Responsibility

By utilizing the card management services provided by PayCaddy through the chatbot interface, you accept full responsibility for any actions executed through the chatbot, including but not limited to blocking or unblocking your card, changing your PIN, and accessing or disclosing your card data. You acknowledge that these actions are initiated and authorized by you, the cardholder, and that PayCaddy acts solely as a facilitator of these actions based on your instructions. You agree to exercise due diligence and caution when using the chatbot for card management purposes, ensuring the accuracy and validity of all instructions provided. PayCaddy shall not be liable for any consequences resulting from your actions or decisions made using the chatbot, including but not limited to unauthorized transactions, data exposure, or card misuse. By accepting this responsibility, you affirm your understanding of the implications of using the chatbot for card management and agree to hold PayCaddy harmless from any claims, losses, or damages arising from your use of the service.

  1. Log Conservation

PayCaddy retains a log of all actions executed by users through the chatbot interface. This log includes timestamps documenting the date and time of each action performed, as well as details of the action itself, such as card activations, deactivations, PIN changes, and any other card management activities initiated by the user. The purpose of maintaining this log is to provide a historical record and timestamp evidence of user interactions with the chatbot for regulatory compliance, security monitoring, and dispute resolution purposes. By using the chatbot for card management services, you acknowledge and consent to the conservation of these logs by PayCaddy. You understand that this log conservation is essential for maintaining the integrity and security of the card management system and agree that PayCaddy may access and utilize this information as necessary in accordance with applicable laws and regulations.

  1. Compliance with Regulatory Requirements for Internet Banking Services

In accordance with Agreement No. 001-2022 of the Bank Superintendency of Panama and subsequent regulations governing electronic banking, PayCaddy hereby affirms that its chatbot services are designed and operated to comply with the stipulated requirements for the provision of banking services over the internet. The chatbot functionalities are regularly reviewed and updated to ensure adherence to the best practices for data protection, secure information processing, and customer interaction as mandated by Panamanian banking regulations.

Our chatbot serves as an interactive tool to facilitate user access to banking services, providing information and assistance in a manner that prioritizes the security and confidentiality of user data. PayCaddy commits to the implementation of robust measures to protect personal data processed by the chatbot, including but not limited to encryption, access controls, and continuous monitoring for potential security breaches.

Use of this chatbot constitutes acknowledgment by the user of the chatbot's role as part of our broader commitment to upholding the regulatory frameworks established by the Superintendency of Banks of Panama. Users are encouraged to interact with the chatbot within the guidelines of secure internet usage and report any discrepancies or concerns to our data protection officer as stipulated under the regulations.

  1. Intellectual Property

All rights, title, and interest in and to the chatbot and any content derived from it are and will remain the exclusive property of PayCaddy and its licensors.

  1. Disclaimers

The PayCaddy chatbot is provided "as is" and "as available" without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  1. Limitation of Liability

PayCaddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the chatbot.

  1. Third-Party Responsibility

PayCaddy provides the chatbot service for card management purposes, which may involve the engagement of third-party service providers or partners to facilitate certain functionalities or operations of the service. You acknowledge and agree that PayCaddy shall not be held liable for any breach of information or data security incidents arising from the actions or omissions of such third parties. While PayCaddy takes reasonable measures to select and engage reputable third-party service providers with appropriate security measures in place, it cannot guarantee the actions or security practices of these parties.

You further understand that any interaction or transaction conducted with third-party service providers through the chatbot interface is subject to the terms and conditions, privacy policies, and security practices of those parties. PayCaddy does not assume responsibility for the actions, services, or security measures of third parties, including but not limited to the handling of personal or financial information, compliance with data protection laws, or resolution of disputes.

By using the chatbot service, you agree to indemnify and hold PayCaddy harmless from any claims, losses, damages, or liabilities arising from or related to the actions or omissions of third-party service providers engaged in connection with the chatbot service. This limitation of liability extends to any breach of information or data security incidents attributable to third parties, and you acknowledge that PayCaddy's liability in such cases is expressly limited to the extent permitted by applicable laws and regulations.

  1. Modifications to Terms

PayCaddy reserves the right to modify these Terms at any time. We will provide notice of these changes by updating the terms on our website and/or through the chatbot interface. Your continued use of the chatbot after any such change constitutes your acceptance of the new Terms.

  1. Governing Law

These Terms shall be governed and construed in accordance with the laws of Panama, without regard to its conflict of law provisions.
